Family Law Mediation

Mediation is a model of negotiation whereby the parties agree to meet with a neutral mediator who will guide them through the process of negotiating the terms of their divorce. It is another alternative to the traditional litigation approach of resolving conflict. However, it differs from the collaborative divorce model in that the parties negotiate face-to-face without the presence of their attorneys or advocates. Should the parties choose to have attorneys, the attorneys will act as counselors advising the parties outside of the mediation session. The attorneys seldom attend the mediation session; however, they may review the final agreement and make suggestions for changes. The mediator is a neutral professional, typically trained as an attorney, whose responsibility is to work with both parties to develop a fair resolution of all the issues raised by the divorce and to prepare a final document for the parties to review.
